Jakarta,web1.jurnaltipikor.com,–Wakil Jaksa Agung Feri Wibisono menyampaikan bahwa profesi seorang Jaksa dianalogikan sebagai two sides of the same coin atau dua sisi mata uang yang sama, artinya profesi Jaksa merupakan suatu kebanggan yang harus disyukuri namun juga memiliki beban risiko hukum yang tinggi.
Hal itu disampaikan oleh Wakil Jaksa Agung saat memberikan ceramah pimpinan pada Pendidikan dan Pelatihan Pembentukan Jaksa (PPPJ) Angkatan LXXXI Gelombang I Tahun 2024 yang dilaksanakan pada Rabu 11 September 2024 di Aula Sasana Adhika Karya, Kampus A, Badan Pendidikan dan Pelatihan Kejaksaan RI.
“Setelah dilantik menjadi Jaksa, siswa PPPJ dihadapkan dengan berbagai risiko hukum. Contohnya adalah saat masa prapenuntutan yang dibatasi dengan jangka waktu pada setiap tahapannya. Seorang Jaksa memiliki tanggung jawab menyelesaikan proses itu sesuai dengan jangka waktu yang ditetapkan oleh Kitab Undang-Undang Hukum Acara Pidana (KUHAP),” ujar Wakil Jaksa Agung.

Selain itu, menurut Wakil Jaksa Agung beban risiko hukum juga diterima saat masa pelaksanaan peradilan pidana yang menyangkut kepentingan dan hak asasi Tersangka/Terdakwa, karena harus dihormati dan dipenuhi sesuai dengan hukum acara pidana.
“Hal itu dapat diwujudkan melalui perspektif accususatoir dengan menempatkan kedudukan Tersangka/Terdakwa sebagai subjek bukan objek,” imbuh Wakil Jaksa Agung.
Wakil Jaksa Agung juga berpesan agar seorang Jaksa harus mampu mempertimbangkan rasionalitas pada setiap keterangan yang termuat dalam berita acara pemeriksaan dan kaitannya dengan tingkat kemungkinan dalam proses pembuktian, serta yang paling utama adalah seorang Jaksa harus mengedepankan hati Nurani.
