Denpasar, JURNAL TIPIKOR – Mantan Rektor Universitas Udayana Prof. I Nyoman Gde Antara divonis bebas oleh Majelis Hakim Pengadilan Tindak Pidana Korupsi Denpasar dalam putusan sidang kasus dugaan tindak pidana korupsi dana sumbangan pengembangan institusi (SPI).
Putusan terhadap Prof. Antara dibacakan oleh Ketua Majelis Hakim Agus Akhyudi bersama Hakim Anggota Putu Sudariasih, Nelson, Gede Putra Astawa dan Soebekti di Pengadilan Tipikor Denpasar, Bali, Kamis.
Hakim memutuskan berdasarkan fakta persidangan, Prof. Antara tidak terbukti bersalah sehingga dibebaskan dari semua tuntutan Jaksa Penuntut Umum Kejaksaan Tinggi Bali. Hakim menilai dakwaan Jaksa baik dakwaan primer maupun subsider pertama, kedua dan ketiga tidak dapat dibuktikan dalam persidangan karena itu terdakwa Prof Antara dibebaskan dari semua dakwaan jaksa.
Dalam uraian Majelis Hakim, Prof. Antara tidak terbukti bersalah melanggar Pasal 12 huruf e Juncto Pasal 18 Undang-Undang 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi, sebagaimana diubah dengan UU Nomor 20 tahun 2001 tentang Perubahan UU Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi jo. Pasal 55 ayat (1) ke-1 KUHP dan Pasal 65 KUHP sebagaimana tuntutan Jaksa Penuntut Umum.
“Membebaskan terdakwa Prof. Dr. Ir. I Nyoman Gde Antara tidak terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana sebagaimana dakwaan kesatu subsider,” kata Majelis Hakim Agus Akhyudi.
Hakim juga memerintahkan terdakwa Prof. I Nyoman Gde Antara dibebaskan dari tahanan sementara setelah putusan itu diucapkan.

Selain itu, hakim juga memutuskan pemulihan hak terdakwa Prof. Dr. I Nyoman Gde Antara dalam kemampuan, kedudukan serta jabatannya.
Terhadap putusan hakim, Jaksa Penuntut Umum Kejaksaan Tinggi Bali langsung menyatakan akan mengajukan banding. Sementara terdakwa Prof. Antara dan penasihat hukumnya langsung menerima putusan tersebut.
Sementara itu, Prof. Antara usai persidangan mengaku sangat bahagia mendengar putusan majelis hakim tersebut. Dia mengatakan memang sepatutnya hakim memutuskan seperti itu karena dirinya yakin tidak melakukan tindak pidana yang didakwakan Jaksa.
“Sedari awal kami sudah mengatakan bahwa kami tidak melakukan seperti yang disangkakan kepada kami. Tetapi kami menghargai proses hukum. Dan kita menyaksikan bahwa tidak terbukti bahwa korupsi. Itulah yang sebetulnya terjadi,” kata Prof. Antara.(*)
