Jakarta, JURNAL TIPIKOR – Peneliti bidang hukum pada The Indonesian Institute (TII) Center for Public Policy Research Christina Clarissa Intania mengatakan bahwa penahanan Sekretaris Jenderal PDI Perjuangan (PDIP) Hasto Kristiyanto oleh Komisi Pemberantasan Korupsi (KPK), atas perannya dalam perkara dugaan suap pengurusan pergantian antarwaktu (PAW) anggota DPR dan perintangan penyidikan, murni penegakan hukum karena kecukupan alat bukti.
“Hasto bisa ditetapkan sebagai tersangka hanya setelah ada kecukupan alat bukti pemula oleh KPK, jika tidak ada tentu tidak akan terjadi demikian,” kata Christina saat dihubungi ANTARA dari Jakarta, Sabtu.
Menurutnya, Hasto sudah masuk di dalam radar KPK sejak tahun 2020 di kasus yang melibatkan Wahyu Setiawan, Agustiani Tio, Saeful, dan Harun Masiku. Dengan demikian, ini menjadi langkah lanjutan KPK dalam menindaklanjuti peran Hasto dan keterlibatannya dalam kasus Harun Masiku.
Selain itu, KPK juga masih berwenang melakukan penyidikan dan penuntutan, walau dalam UU KPK Nomor 19 Tahun 2019, pimpinan KPK dinyatakan sebagai pejabat negara. Terlebih, tugas penyidikan dan penuntutan masih melekat pada KPK.
Dengan kabar Hasto akan kembali mengajukan praperadilan setelah praperadilan sebelumnya tidak diterima, ini mencerminkan “access to justice” yang masih tersedia untuk Hasto. Namun di saat yang bersamaan, KPK perlu tetap menindaklanjuti proses hukum supaya siap memasuki tahap persidangan.
Christina tak menutup kemungkinan terhadap UU KPK terbaru cukup menghadang langkah KPK untuk bisa sepenuhnya independen, namun langkah ini perlu diacungi jempol dan diapresiasi, serta terus didorong untuk memperkuat pemberantasan korupsi di Indonesia.
Dia berharap KPK bisa terus lebih berani dalam menindaklanjuti tindak pidana korupsi di Indonesia tanpa pengaruh siapapun dan dari manapun.
“Ini yang harus terus kita kawal bersama, apapun kasusnya dan siapapun yang terlibat tanpa terkecuali,” ujarnya.
Tim penyidik Komisi Pemberantasan Korupsi (KPK) menyematkan rompi jingga bertuliskan “Tahanan KPK” kepada Sekretaris Jenderal PDI Perjuangan Hasto Kristiyanto atas perannya dalam perkara dugaan suap pengurusan pergantian antarwaktu (PAW) anggota DPR dan perintangan penyidikan.
Hasto tampak meninggalkan ruang pemeriksaan KPK di lantai 2 Gedung Merah Putih KPK dengan tangan terborgol dan dikawal beberapa petugas KPK, Kamis sore.
Politisi asal Yogyakarta itu hari ini menjalani pemeriksaan oleh penyidik KPK dalam statusnya sebagai tersangka dalam perkara dugaan korupsi tersebut di atas.
Juru Bicara KPK Tessa Mahardhika Sugiarto menegaskan penyidikan dugaan korupsi terhadap Hasto Kristiyanto adalah murni penegakan hukum tanpa ada muatan politik.
“Untuk kesekian kalinya KPK menyampaikan bahwa penetapan tersangka saudara HK bukan bagian dari politisasi kekuasaan,” kata Tessa saat dikonfirmasi di Jakarta.
Penyidik KPK pada hari Selasa, 24 Desember 2024, menetapkan dua orang tersangka baru dalam rangkaian kasus Harun Masiku, yakni Sekretaris Jenderal PDI Perjuangan Hasto Kristiyanto (HK) dan advokat Donny Tri Istiqomah (DTI).
Ketua KPK Setyo Budiyanto mengungkapkan bahwa HK mengatur dan mengendalikan DTI untuk melobi anggota KPU Wahyu Setiawan agar dapat menetapkan Harun Masiku sebagai calon anggota DPR RI terpilih dari Dapil Sumsel I.
HK juga diketahui mengatur dan mengendalikan DTI untuk aktif mengambil dan mengantarkan uang suap untuk diserahkan kepada Wahyu Setiawan melalui Agustiani Tio Fridelina.
“HK bersama-sama dengan Harun Masiku, Saeful Bahri, dan DTI melakukan penyuapan terhadap Wahyu Setiawan dan Agustiani Tio Fridelina sebesar 19.000 dolar Singapura dan 38.350 dolar AS pada periode 16 Desember 2019 sampai dengan 23 Desember 2019 agar Harun Masiku dapat ditetapkan sebagai anggota DPR RI periode 2019—2024 dari Dapil Sumsel I,” ujar Setyo.
Selain itu, penyidik KPK juga turut menetapkan Hasto sebagai tersangka dalam perkara obstruction of justice atau perintangan penyidikan.(Antara)
