Jakarta, JURNAL TIPIKOR – Mahkamah Agung (MA) mengatakan bahwa kerugian negara dalam suatu perkara korupsi harus nyata, bukan sebatas potensi saja.
“Kerugiannya harus nyata itu berdasarkan Putusan Mahkamah Konstitusi Nomor 25 Tahun 2016, dan declare (diumumkan, red.) dari BPK (Badan Pemeriksa Keuangan) bahwa korupsi itu harus nyata,” kata Juru Bicara MA, Yanto, di Gedung MA, Jakarta, Kamis (2/1).
Yanto menjelaskan bahwa hakim mengacu kepada Pasal 2 dan 3 Undang-Undang Nomor 20 Tahun 2001 tentang Tindak Pidana Korupsi (UU Tipikor) yang telah diperkarakan dan diputuskan melalui Putusan MK Nomor 25 Tahun 2016.

Pada putusan tersebut, Mahkamah berpendapat penerapan unsur merugikan keuangan dengan menggunakan konsepsi actual loss (kerugian nyata, red.) dapat lebih memberikan kepastian hukum yang adil dan bersesuaian dengan upaya sinkronisasi dan harmonisasi instrumen hukum nasional maupun internasional.
Sementara itu, saat ditanyai oleh para jurnalis mengenai potensi kerugian negara karena kerusakan lingkungan pada kasus yang melibatkan terdakwa Harvey Moeis, dia mengatakan tidak bisa menyinggung perkara tersebut.
Akan tetapi, dia menekankan bahwa secara teori maka kerugian negara karena kerusakan lingkungan dinilai sebatas potensi saja, bukan kerugian nyata.
“Kalau secara teori, kan kalau di tipikor tidak lagi menjadi potential loss, tetapi actual loss, seperti itu, harus nyata kerugiannya. Itu didasarkan kepada Putusan Mahkamah Konstitusi Nomor 25 Tahun 2016, dan declare BPK,” ujarnya.(*)
