Jakarta, JURNAL TIPIKOR – Komisi Pemberantasan Korupsi (KPK) tengah mengkaji Undang-Undang Nomor 1 Tahun 2025 tentang Badan Usaha Milik Negara (UU BUMN), dan membandingkannya dengan peraturan lain yang sudah berlaku di Tanah Air.
Anggota Tim Juru Bicara KPK Budi Prasetyo menjelaskan bahwa kajian tersebut dilakukan untuk menyikapi substansi UU BUMN yang menyatakan direksi maupun komisaris BUMN tidak termasuk sebagai penyelenggara negara.
“Dalam melakukan kajian tersebut, KPK tentu juga akan melihat peraturan dan ketentuan lainnya, seperti KUHAP, Undang-Undang Tindak Pidana Korupsi, Undang-Undang Keuangan Negara, dan sebagainya,” ujar Budi di Gedung Merah Putih KPK, Jakarta, Senin (5/5/2025)

Lebih lanjut dia menjelaskan bahwa UU BUMN dikaji untuk melihat kaitannya dengan tugas, fungsi, dan kewenangan KPK dalam memberantas korupsi melalui pendekatan pendidikan, pencegahan, dan penindakan.
Dengan demikian, kata dia, kajian yang dilakukan secara komprehensif dapat menghasilkan hasil yang objektif, terutama menyikapi perubahan status direksi maupun komisaris BUMN dalam UU BUMN terbaru.
“KPK memandang penting untuk melakukan intervensi-intervensi pencegahan korupsi, sehingga kami bisa betul-betul mendorong praktik-praktik bisnis yang berintegritas. Dengan demikian, kami bisa mendorong penciptaan iklim bisnis yang bersih,” katanya.
UU Nomor 1 Tahun 2025 merupakan peraturan perundang-undangan yang baru ditetapkan, dan berlaku sejak 24 Februari 2025. UU tersebut mengubah UU Nomor 19 Tahun 2003 tentang BUMN.
Pasal 9G dalam UU BUMN terbaru berbunyi: “Anggota Direksi, Dewan Komisaris, dan Dewan Pengawas BUMN bukan merupakan penyelenggara negara.”
