Saat ini presiden RI Prabowo Subiyanto begitu semangat dan gencar-gencarnya memburu koruptor keuangan negara, fakta beberapa kasus besar baik oknum BUMN dan oknum penyelenggara negara tertangkap ini sebuah semangat dan implementasi yang sangat di apresiasi .
KPK sebuah komisi institusi gabungan yang dibentuk khusus pemberantasan tipikor Tindak Pidana Korupsi yang merugikan negara dilakukan oleh penyelenggara negara sesuai dengan UU KPK pasal 11 ayat 1 menyatakan bahwa KPK berwenang melakukan penyelidikan, penyidikan dan penuntutan tindak pidana korupsi yang melibatkan aparat penegak hukum , penyelenggara negara dan orang lain serta/ atau menyangkut kerugian negara paling sedikit 1 milliar ”
Jika kita simak UU no 1 tahun 2025 UU Badan usaha milik negara (BUMN ) ada dua pasal yang menjadi pemikiran kita dalam pasal 3x ayat 1 berbunyi ” Organ dan pegawai Badan bukan sebagai penyelenggara negara”, selanjutnya pasal 9G berbunyi ” Anggota direksi ,dewan komisaris dan dewan pengawas BUMN bukan penyelenggara Negara ”
BPK adalah perangkat negara sebagai auditor negara satu kesatuan dengan KPK sebagai bagian mekanisme penindakan tipikor .BPK diatur dan tercantum dalam UUD 45 yaitu lembaga negara yang bertugas memeriksa pengelolaan dan tanggung jawab keuangan negara. Dalam UUD 1945, BPK diatur dalam Bab VIIIA, khususnya Pasal 23E, 23F, dan 23G. BPK berperan penting dalam memastikan transparansi dan akuntabilitas pengelolaan keuangan negara.
Indonesia memiliki BUMN 65 .BUMN sebuah badan usaha yang mayoritas saham dimiliki oleh negara sebagai penanggung jawab dibawah kementerian BUMN , Menteri BUMN seorang pejabat tinggi negara artinya penyelenggara negara. Direksi ,dewan komisaris dan dewan pengawas diangkat oleh Menteri BUMN. Penyertaan saham BUMN adalah uang milik negara .

UU BUMN no 1 tahun 2025 dengan menyebut bukan sebagai penyelenggara negara itu sebuah tujuan melepaskan diri dari kewenangan KPK , KPK sebuah alat penegak hukum negara yang seharusnya tidak hanya berlaku di kalangan penyelenggara pemerintahan saja seharusnya berlaku juga untuk pejabat BUMN karena BUMN dibawah tanggung jawab langsung kementerian BUMN dan menteri BUMN sebagai penyelenggara negara selain itu pun pejabat tinggi BUMN ditetapkan oleh Menteri BUMN , negara sebagai penyetor modal saham tertinggi artinya walau BUMN sebagai badan usaha bisnis oriented tetap negara ada didalamnya sebagai pemegang saham tertinggi dan uang yang disetorkan ke BUMN itu uang negara.
Pengawasan dan pemeriksaan keuangan negara BPK terhadap BUMN itupun terlepas oleh UU no 1 /2025 ini sangat mengkhawatirkan sekali terhadap jumlah 65 BUMN mengelola uang negara ribuan triliun tidak akan terkendali kebocoran karena tidak ada pengawasan ,pemeriksaan BPK sebagai auditor negara bagaimana negara akan mengetahui uang yang disetorkan ke BUMN jika tidak ada laporan ,pengawasan dan pemeriksaan BPK .
Jika KPK tidak ada kewenangan terhadap BUMN harapan kita Kejaksaan Agung harus lebih focus bila perlu dibentuk Satgasus BUMN tegas kang Iyus
