Menkum Supratman: Revisi UU Tapera Kemungkinan Dibahas Bersamaan dengan Rancangan UU Perumahan

JAKARTA, JURNAL TIPIKOR—– Menteri Hukum (Menkum) Supratman Andi Agtas mengungkapkan bahwa proses revisi Undang-Undang (UU) tentang Tabungan Perumahan Rakyat (Tapera), menyusul adanya putusan Mahkamah Konstitusi (MK), kemungkinan besar akan dibahas bersamaan dengan pembahasan Rancangan UU tentang Perumahan.

Pernyataan ini disampaikan Supratman di kompleks parlemen, Jakarta, pada hari Selasa. Ia menjelaskan bahwa Kementerian Hukum telah berkoordinasi dan mengantisipasi putusan MK tersebut bersama dengan Kementerian Perumahan dan Kawasan Permukiman. Kementerian ini memang sedang mempersiapkan draf UU Perumahan.

“Nah karena ada putusan MK yang baru, mungkin akan dibahas bersamaan dengan Undang-Undang tentang Tapera,” kata Supratman.

Kewajiban Kepesertaan Tapera Dibatalkan MK

Langkah penataan ulang ini diambil setelah Mahkamah Konstitusi (MK) pada hari Senin memutus bahwa kepesertaan Tapera tidak lagi menjadi suatu kewajiban.

Putusan ini merupakan respons atas dikabulkannya uji materi terhadap Undang-Undang Nomor 4 Tahun 2016 tentang Tapera.

MK menyatakan bahwa pasal utama dalam UU Tapera, yakni Pasal 7 ayat (1), bertentangan dengan konstitusi. Hal ini berdampak yuridis pada pasal-pasal lainnya dalam UU tersebut.

“Menyatakan UU Nomor 4 Tahun 2016 tentang Tapera bertentangan dengan Undang-Undang Dasar NRI Tahun 1945 dan tidak mempunyai kekuatan hukum mengikat sepanjang tidak dilakukan penataan ulang, sebagaimana amanat Pasal 124 UU Nomor 1 Tahun 2011 tentang Perumahan dan Kawasan Pemukiman,” ujar Ketua MK Suhartoyo saat membacakan amar Putusan Nomor 96/PUU-XXII/2024.

Pemerintah dan DPR Punya Waktu Dua Tahun

Menkum Supratman menambahkan bahwa putusan MK yang menyatakan UU Tapera sebagai inkonstitusional bersyarat memberi waktu kepada Pemerintah dan DPR untuk menata kembali persoalan tabungan perumahan.

“Karena dinyatakan sebagai putusan yang inskonstitusional bersyarat, maka kita masih punya waktu dua tahun untuk membenahi itu, tapi mudah-mudahan lebih cepat,” tegasnya.

Menurut Supratman, pembahasan mengenai perumahan ini sudah diagendakan, di mana UU Perumahan telah dimasukkan ke dalam Program Legislasi Nasional (Prolegnas) Tahun 2026.

Pemerintah berharap penataan ulang dan revisi dapat dilakukan lebih cepat dari batas waktu dua tahun yang diberikan MK.
