Jakarta, JURNAL TIPIKOR – Kuasa hukum Sekretaris Jenderal PDI Perjuangan (PDIP) Hasto Kristiyanto, Ronny Talapessy mengklaim bahwa perkara kliennya pada hari ini, pukul 10.00 WIB, memasuki tahap II pelimpahan atau penyerahan tersangka dan barang bukti dari penyidik kepada jaksa penuntut umum (JPU).
Informasi tersebut didapatkan Ronny melalui pesan WhatsApp (WA) dari pihak KPK.
“Kami mendapat pesan WhatsApp kemarin bahwa Sekjen PDI Perjuangan Mas Hasto Kristiyanto hari ini Kamis pukul 10.00 akan dilakukan tahap II penyerahan bukti dan tersangka,” kata Ronny saat dihubungi ANTARA dari Jakarta, Kamis.
Adapun tahap ini dilakukan setelah penyidik menyatakan berkas perkara lengkap (P-21). Sementara pada Rabu (26/2), tim kuasa hukum Hasto telah memasukkan surat untuk saksi yang meringankan di tingkat penyidikan untuk kliennya, yaitu menghadirkan tiga ahli dari berbagai universitas.
“Ini untuk memenuhi hak klien kami sesuai pasal 65 KUHAP dan asas praduga tak bersalah,” ujarnya.
Dia menilai bahwa ketidakhadiran KPK pada sidang praperadilan hari Senin (3/3) untuk mempercepat berkas tanpa mengindahkan dan patuh terhadap KUHAP, UU KPK serta prinsip-prinsip penghormatan terhadap HAM dan hak-hak hukum kliennya yang dilindungi oleh UU.
Sebelumnya, hakim tunggal Pengadilan Negeri Jakarta Selatan Djuyamto pada Kamis (13/2) menyatakan tidak dapat menerima gugatan praperadilan status tersangka Sekretaris Jenderal PDI Perjuangan Hasto Kristiyanto.
Hakim mengabulkan eksepsi dari termohon (KPK), menyatakan permohonan praperadilan pemohon (Hasto) tidak dapat diterima dan membebankan biaya perkara kepada pemohon sejumlah nihil.
Penyidik KPK pada Selasa, 24 Desember 2024, menetapkan dua orang tersangka baru dalam rangkaian kasus Harun Masiku, yakni Sekretaris Jenderal PDI Perjuangan Hasto Kristiyanto (HK) dan advokat Donny Tri Istiqomah (DTI).
Ketua KPK Setyo Budiyanto mengungkapkan bahwa HK mengatur dan mengendalikan DTI untuk melobi anggota KPU Wahyu Setiawan agar dapat menetapkan Harun Masiku sebagai calon anggota DPR RI terpilih dari Dapil Sumsel I.
HK juga diketahui mengatur dan mengendalikan DTI untuk aktif mengambil dan mengantarkan uang suap untuk diserahkan kepada Wahyu Setiawan melalui Agustiani Tio Fridelina.
Selain itu, penyidik KPK juga turut menetapkan Hasto sebagai tersangka dalam perkara perintangan penyidikan (obstruction of justice).
