JURNAL TIPIKOR – Carut-marut penanganan sidang tindak pidana korupsi (tipikor) terdakwa Dadan Setiadi Megantara, Cs., dalam kasus pengadaan tanah Proyek Strategis Nasional (PSN) Tol Cisumdawu terus menjadi sorotan. Sidang yang awalnya bersumber dari sengketa kepemilikan tanah antara Dadan Setiadi Megantara dan ahli waris Antijah Binti Moetakin, yakni Udju, Cs., kini memunculkan berbagai dinamika hukum.
Dalam perkara perdata No. 32/Pdt.G/2021/PN. Smd Jo. No. 340/PDT/2022/PT BDG Jo. No. 2660 K/Pdt/2023 yang telah berkekuatan hukum tetap (BHT), Udju, Cs. dinyatakan sebagai pemilik sah tanah tersebut. Sebagai konsekuensi, uang ganti rugi sebesar Rp329.718.300.000 diserahkan kepada mereka melalui cek tunai. Namun, pencairan uang ini terhambat karena Jaksa Penuntut Umum (JPU) berusaha menjadikan dana tersebut sebagai barang bukti dalam kasus tipikor Dadan, Cs.
Iyus Ruslan, Koordinator LCKI Jawa Barat, menegaskan, bahwa kasus tipikor Dadan, Cs. tidak seharusnya mencampuri hak yang telah ditetapkan melalui putusan pengadilan perdata. “Proses hukum harus sesuai koridor. Jangan ada abuse of power. Penetapan pencairan konsinyasi oleh Pengadilan Negeri Sumedang sudah jelas, dan BTN wajib melaksanakan perintah tersebut,” ujarnya.

Dalam persidangan tipikor yang dimulai Agustus 2024, JPU berupaya menyita dan memblokir dana tersebut. Namun, permohonan itu ditolak majelis hakim tipikor karena tidak memenuhi syarat. Bahkan hingga saat ini, dana yang tersimpan di Rekening Penampungan Lain (RPL) Pengadilan Negeri Sumedang di Bank BTN tidak pernah disita ataupun diblokir, sehingga tidak dapat dijadikan barang bukti.
Perhitungan kerugian negara juga menuai polemik. Saksi ahli dari BPKP, Wenny, mengakui bahwa data yang digunakan dalam perhitungan sebesar Rp329 miliar hanya bersumber dari dokumen administratif tanpa verifikasi langsung ke lapangan. Sementara itu, Mono Igfirly dari KJPP tetap merujuk pada laporan KJPP yang berbeda dari simulasi angka kerugian versi JPU.
Advokat senior Herman Thahir, SH., MH., mengingatkan agar semua pihak menghormati proses hukum yang berjalan. “Sengketa perdata sudah selesai dan berkekuatan hukum tetap. Pelaksanaan penetapan pencairan adalah kewajiban hukum BTN. Sedangkan perkara tipikor biarkan diproses tanpa intervensi. Hormati UU Tipikor dan aturan beracara,” tegas Herman.

Masyarakat diminta terus mengawal proses hukum kasus ini demi memastikan tidak ada pelanggaran prosedural dan semua pihak bertindak sesuai dengan hukum yang berlaku. Sidang Tipikor di Pengadilan Negeri Bandung akan menjadi penentu kejelasan dari perkara ini. (Red)
