SEMARANG, JURNAL TIPIKOR – Rachmat Utama Djangkar, Direktur Utama PT Deka Sari Perkasa, dijatuhi hukuman 2 tahun 6 bulan penjara atas kasus dugaan suap kepada mantan Wali Kota Semarang, Hevearita G. Rahayu alias Mbak Ita, dan suaminya, Alwin Basri.
Putusan ini dibacakan oleh Hakim Ketua Gatot Sarwadi dalam sidang di Pengadilan Tindak Pidana Korupsi (Tipikor) Semarang pada Senin (30/6/2025), dan sejalan dengan tuntutan jaksa penuntut umum.
Selain pidana penjara, majelis hakim juga menjatuhkan denda sebesar Rp200 juta. Apabila denda tersebut tidak dibayarkan, akan diganti dengan pidana kurungan selama 3 bulan.
Hakim menyatakan terdakwa Rachmat Utama Djangkar terbukti secara sah dan meyakinkan bersalah melanggar Pasal 5 ayat 1 huruf a Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan Undang-Undang Nomor 20 Tahun 2001.
Dalam pertimbangannya, hakim menyatakan bahwa Rachmat Utama Djangkar terbukti memberikan janji berupa uang sebesar Rp1,75 miliar. Uang ini merupakan komitmen fee atas proyek pengadaan meja dan kursi fabrikasi untuk sekolah dasar di sembilan kecamatan di Kota Semarang.
PT Deka Sari Perkasa, perusahaan milik terdakwa, memperoleh pekerjaan pengadaan meja dan kursi sekolah dasar tersebut dengan pagu anggaran sebesar Rp20 miliar melalui Perubahan APBD 2023. Namun, realisasi pemberian janji sebesar 10 persen dari total nilai pekerjaan Rp18 miliar kepada Alwin Basri sempat tertunda.
Hal ini dikarenakan Alwin Basri meminta agar uang tersebut tidak diserahkan karena adanya penyelidikan oleh Komisi Pemberantasan Korupsi (KPK) terkait dugaan korupsi di lingkungan Pemerintah Kota Semarang pada saat itu.
Meskipun demikian, hakim menilai terdakwa Rachmat Utama tetap terbukti memberikan hadiah atau janji kepada penyelenggara negara. Perbuatan terdakwa dianggap bertentangan dengan program pemerintah dalam upaya pemberantasan tindak pidana korupsi.
Sebagai bentuk itikad baik, terdakwa Rachmat Djangkar sebelumnya telah menitipkan uang sebesar Rp1,75 miliar ke rekening penampungan KPK.
Atas putusan ini, baik pihak terdakwa maupun jaksa penuntut umum menyatakan pikir-pikir mengenai langkah hukum selanjutnya.
