Jakarta, JURNAL TIPIKOR – Wakil Ketua Komisi Pemberantasan Korupsi (KPK) Johanis Tanak mengusulkan agar Rancangan Undang-Undang tentang Perubahan atas Undang-Undang Nomor 8 Tahun 1981 tentang Hukum Acara Pidana (RUU KUHAP) mewajibkan penyelidik dan penyidik memiliki pendidikan minimal sarjana ilmu hukum.
“Penyelidik dan penyidik harus berpendidikan serendah-rendahnya strata satu atau S-1 ilmu hukum sehingga seluruh aparat penegak hukum berlatar belakang pendidikan S-1 ilmu hukum,” ujar Tanak saat dihubungi dari Jakarta, Jumat (30/5/2025).
Ia menjelaskan bahwa usulan ini didasari oleh fakta bahwa saat ini tidak ada persyaratan pendidikan S-1 ilmu hukum bagi penyelidik dan penyidik, sementara profesi hukum lain seperti advokat, jaksa, dan hakim sudah diwajibkan demikian.

Selain itu, Tanak juga mengusulkan agar RUU KUHAP menghilangkan peran penyidik pembantu karena dinilai sudah tidak relevan lagi.
“Tenggang waktu penyidikan juga harus diatur dengan jelas dan tegas supaya ada kepastian hukum. Begitu juga halnya tenggang waktu proses pemeriksaan persidangan harus diatur dengan jelas dan tegas agar ada kepastian hukum bagi pencari keadilan,” katanya.
Usulan ini diharapkan dapat meningkatkan kualitas dan profesionalisme aparat penegak hukum, serta memberikan kepastian hukum yang lebih baik bagi masyarakat.
